The Court of Appeal upheld the 50-year-jail sentence on a man found guilty of two counts of incest with his 14-year-old daughter. A three-member bench consisting of Justice Datuk Vazeer Alam Mydin Meera, Datuk Azmi Ariffin, and High Court Judge Datuk Noordin Badaruddin dismissed the 45-year-old man’s request for a reduced jail term. However, they allowed his appeal for the 20 whipping sentence imposed on him to be reduced to 10 strokes by the Session Court.
Justice Vazeer stated that the 25-year jail term for each charge was not excessively severe, considering the relationship between the appellant and the victim, who is his biological child. He emphasized that the father should take care of the victim, not subject her to rape.
On August 19, 2022, the Sessions Court found the man guilty of committing incest with the girl at a house in Klang district, Selangor, on April 8, 2019, and April 16, 2019. He was sentenced to 25 years in jail and 10 strokes of the rotan for each charge, to be served consecutively. The man’s appeal to the High Court was dismissed on March 6 of last year.
The same panel affirmed a 15-year jail sentence and one stroke of the cane imposed on a farmer for raping his daughter. Justice Vazeer stated that the jail sentence was not excessively harsh, noting that the victim was still the man’s biological daughter even though she was born out of wedlock. On April 14, 2022, the 51-year-old man was sentenced to 15 years in jail and one stroke of the cane after pleading guilty to raping the girl. Unhappy with the jail sentence, he appealed to the High Court but it was dismissed on February 9 last year. – Bernama
