KUALA LUMPUR: Tan Sri M. Kayveas was unsuccessful in seeking the High Court’s permission to start a judicial review to overturn the appointment of (the late) Datuk Seri Maglin Dennis D’Cruz as president of the People’s Progressive Party (MyPPP) on Monday (Nov 20).
Federal counsel Muhammad Hairuliqram Hairuddin, representing the Attorney-General’s Chambers (AGC) said Judge Datuk Amarjeet Singh rejected the application via e-mail.
Kayveas’ lawyer Syereen Tang confirmed the matter.
On Aug 3, the AGC opposed the leave for judicial review on the grounds that the issue raised by Kayveas could not be subjected to judicial review as it violated Section 18C of the Societies Act 1966. The AGC also stated that the court was not authorized to review party-related issues.
Kayveas filed the motion on July 7, naming the Home Minister and Registrar of Societies (RoS) as the first and second respondents respectively.
The application was filed based on the argument that the two respondents overlooked the party’s 67th Annual General Meeting (AGM), held on March 19, where Maglin was appointed as MyPPP president, was invalid due to the 13 individuals who attended the meeting being expelled as members effective April 25, 2018.
Among other things, the seasoned politician sought to declare that the party’s AGM was invalid and alleged that Maglin’s appointment violated the party constitution.
He also sought an order to reverse the decision of a Home Ministry officer, made through a letter dated April 11, in approving the appeal against the party’s deregistration.
MyPPP was deregistered on Jan 14, 2019.
Maglin passed away at the age of 67 on Nov 17. -Bernama
