    High Court dismisses appeal by labourer convicted of raping pregnant woman

    KUALA TERENGGANU: The High Court here has upheld the nine-year prison sentence and three strokes of the cane imposed on a labourer for raping a pregnant woman in Kemaman five years ago.

    Justice Datuk Hassan Abdul Ghani, in upholding the sentence on Wednesday (Oct 9), dismissed the appeal by Mohammad Sukri Jaafar, 43, and ordered the man to begin serving the sentence immediately.

    Sukri, represented by lawyer Muhammad Nadzir Abdullah, was found guilty of rape by the Kemaman Sessions Court on Jan 16 after it found that the prosecution had succeeded in proving its case beyond reasonable doubt.

    He was charged with raping the then 20-year-old woman, who was seven months pregnant, at a garbage dump in Kampung Mak Chili, Chukai, Kemaman at 10am on Oct 25, 2019.

    The charge was framed under Section 376(1) of the Penal Code which provides for imprisonment of up to 20 years and whipping upon conviction.
