    ICC issues arrest warrants for Russian commanders Kobylash and Sokolov

    According to a statement released by the International Criminal Court (ICC) on Tuesday, arrest warrants have been issued for top Russian commanders Sergei Kobylash and Viktor Sokolov for alleged war crimes in Ukraine. The ICC, headquartered in The Hague, stated that there were reasonable grounds to believe that the two suspects were responsible for missile strikes carried out by forces under their command against the Ukrainian electric infrastructure from at least 10 October 2022 until at least 9 March 2023.

    This marks the second set of warrants for the arrest of Russian officials related to the war in Ukraine. In March of the previous year, the ICC issued warrants for the arrest of President Vladimir Putin and Children’s Commissioner Maria Lvova-Belova on war crimes charges linked to the abduction of Ukrainian children, allegations that the Kremlin has denied.

    The ICC emphasized that the attacks on Ukraine’s electrical grid resulted in civilian harm and damage that exceeded any expected military advantage. Ukrainian prosecutors had already been investigating potential war crimes following a winter campaign of air strikes on energy and utilities infrastructure in Ukraine.

    Russia has denied intentionally targeting civilian infrastructure in Ukraine, asserting that their attacks are aimed at diminishing Kyiv’s ability to fight. The rules outlined in the Geneva Conventions and additional protocols established by international courts stipulate that parties involved in a military conflict must differentiate between civilian objects and military objectives, with attacks on civilian objects prohibited.

    While the principle appears straightforward, some infrastructure owned and utilized by civilians may also be classified as a military objective if they can significantly contribute to military operations or if their destruction provides a clear military advantage. Experts have contended that civilian power plants or railways could potentially fall within this category.

    Overall, the situation highlights the complexity and challenges in adhering to the laws of war, particularly when determining the targets and proportionality of military actions.
