KUALA LUMPUR: A lorry driver stood trial in the Ampang Magistrate’s Court today, facing charges for causing the death of a high-powered motorcycle rider on the Sungai Besi-Ulu Kelang Elevated Expressway (Suke) Expressway last month due to reckless driving. Mudzyadaha Mohammad, 42, who himself suffered a broken right arm in the incident, pleaded not guilty to the charge. The accident occurred on June 14 at kilometer 22.2 of the SUKE Highway when Ahmad Fadzil Omar Azaddin, 64, tragically lost his life as a result of Mudzyadaha riding a motorcycle against the flow. If convicted, Mudzyadaha could face imprisonment for not less than five years and a fine ranging from RM20,000 to RM50,000, in addition to a driving license disqualification for five years from the date of conviction.

Deputy public prosecutor Annur Athirah Amran requested a bail of RM15,000 for Mudzyadaha, along with one surety. He was also asked to surrender his passport to the court and to report himself at the nearest police station until the case is resolved. Representing Mudzyadaha, lawyer Izleen Ismail from the National Legal Aid Foundation revealed that the accused is a person with disabilities (PwD) who suffers from mental problems and receives aid from the Social Welfare Department. Izleen asserted that Mudzyadaha’s inability to think rationally during the incident led to the head-on collision, as confirmed by a reference letter from a doctor at Kajang Hospital. Furthermore, Izleen stated that her client, a lorry driver earning RM2,200 per month, has been dealing with stress issues since losing his job as a train driver. With an unemployed wife and three children to support, Izleen requested a court order for Mudzyadaha to be sent to Hospital Bahagia Ulu Kinta in Perak for mental observation.

Magistrate Amalina Basirah set bail at RM10,000 with one surety and ordered Mudzyadaha to surrender his driving license to the court. The magistrate also approved the application for the accused to undergo mental observation at Hospital Bahagia and scheduled a mention for August 10. According to media reports, Ahmad Fadzil tragically lost his life after falling from the Suke Highway flyover, which is 30 meters high, while trying to avoid colliding with a motorcycle that was going against the traffic flow. The incident was captured on a CCTV camera and the footage went viral on social media.
