Two teenagers in Kuala Selangor have been given the punishment of washing toilets for 100 hours over six months, after causing mischief by fire at a public toilet in Bandar Puncak Alam in 2022. The Magistrate’s Court also ordered a good behaviour bond of RM1,000 for each of the teenagers for two years, as well as reporting to the nearest police station every month over the same period. In addition to these penalties, they are required to attend a workshop organized by the Social Welfare Department.
The teenagers, both 16-year-old students, pleaded guilty to the charge. The incident took place on August 28, 2022, at 2.47pm, and resulted in the destruction of the public toilet at a futsal court in Phase 3 of Bandar Puncak Alam. The charge falls under Section 436 of the Penal Code, which carries a maximum prison sentence of 20 years and a fine.
Prior to the court proceedings, the Welfare Department submitted a moral report on the two accused individuals and made two recommendations, including the suggestion of good behaviour. Public advisers also condemned the actions of the teens for damaging public property and causing harm to the family. The late male teenage victim, Muhammad Damin Mikhail Kansol, was affected by their actions and subsequently passed away.
The Deputy Public Prosecutor, Muhammad Afiq Qiwamuddin Mustapha Shakri, urged the court to impose an appropriate punishment on the teenagers due to the public interest involved in the case. The victim’s family was represented by lawyer Johan Ariff Salim Khan, who served as the legal observer during the proceedings. The accused teenagers did not have legal representation.
It should be noted that Muhamad Damin Mikhail Kansol, the 16-year-old teenager who lost his life, had been involved in a prank with his friends in the same public toilet in Bandar Puncak Alam.
