NEW YORK: Apple’s motion to dismiss a class-action lawsuit alleging that stalkers are using its AirTag devices to track victims has been denied by a judge. The lawsuit claims that Apple has not done enough to prevent stalkers from exploiting AirTags to follow individuals without their consent. AirTags, priced at US$29 (RM137), have gained popularity since their release in 2021 for helping users locate items like keys, wallets, and luggage. However, they have also been misused by stalkers.
Several plaintiffs filed a lawsuit against Apple in December 2022, accusing the tech giant of failing to address the dangers posed by AirTags and not adequately protecting victims. They argued that AirTags have made location-based stalking easier and that current safety features are insufficient. Apple tried to dismiss the lawsuit by stating that it had taken steps to prevent misuse and should not be held liable for actions by third parties, but US District Judge Vince Chhabria rejected that argument.
Judge Chhabria ruled that while most of the plaintiffs’ claims were not well-supported, three claims could proceed under California law for negligence and strict product liability. The other claims were dismissed in a separate order. The ruling included accounts of victims being stalked by former partners or others using AirTags attached to their cars, causing emotional and financial harm.
These cases involved alleged defects in AirTags that made it difficult for victims to understand and stop the tracking, such as unclear or delayed notifications and the inability to disable the devices remotely, prolonging the stalking. Attorney Gillian L. Wade, representing the plaintiffs, expressed gratitude for the opportunity to continue the litigation, emphasizing the need to give voice to victims and advocate for accountability and change.
Apple and its lawyers did not respond to requests for comment following the judge’s decision. In February 2022, before the class action lawsuit was filed, Apple released a statement condemning malicious use of its products and announced plans for updates to enhance safety. The company also collaborated with Google last year on a proposal to establish standards for combating secret surveillance using AirTags and similar devices.
