    Army man slapped with RM2,500 fine for assaulting wife

    KOTA KINABALU: A soldier has been fined RM2,500 by the Magistrate’s Court for assaulting his wife. Mohamad Zul Iskandar Hassan, a Corporal, pleaded guilty to assaulting his 28-year-old wife at their house in the Lok Kawi army camp in Penampang on June 4, 2022. The assault took place because the soldier mistakenly suspected his wife of having an affair.

    Mohamad Zul, 32, was charged under Section 323 of the Penal Code for voluntarily causing hurt, along with Section 326A of the same Code. The charge sheet revealed that he accused his wife of infidelity after noticing she was using WhatsApp to chat with someone. It later turned out that she was actually communicating with another woman to find a babysitter for their child.

    Due to the misunderstanding, the wife suffered physical assault, including being punched in the body, cheek, and back of her head. The charge sheet also indicated that this was not the first time the woman had been assaulted by her husband. However, she decided to lodge a police report this time to take appropriate action and refer the matter to the Syariah Court for divorce proceedings.

    The accused was represented by National Legal Aid Foundation (YBGK) counsel Lim Ming Zoong @ Lawrence, who requested a lower fine during mitigation. Inspector Suzie @ Stephanie Kupit, on the other hand, urged the court to impose a deterrent sentence, considering it was not the first assault incident involving the accused.

    Magistrate Stephanie Sherron Abbie imposed the RM2,500 fine on Mohamad Zul. In default of payment, he would face four months’ imprisonment. The court hopes that such a punishment will discourage future acts of violence against spouses.

    This case highlights the importance of communication and trust within marriage. Misunderstandings like this can lead to severe consequences, and it is crucial for couples to address their concerns calmly and rationally.

    Social support systems, such as the Syariah Court and organizations like the National Legal Aid Foundation, play a vital role in assisting victims of domestic violence and ensuring that appropriate legal action is taken against the perpetrators.

    It is hoped that this case serves as a reminder that violence within the family is not acceptable and will not be tolerated by the law.
