    Borneo centre for arbitration and mediation launches new rules

    The Borneo International Centre for Arbitration and Mediation (Bicam) has officially launched its arbitration and mediation rules, marking the beginning of its full operations. Bicam chairman Tan Sri David Wong Dak Wah stated that these rules will pave the way for a new era of excellence in alternative dispute resolution (ADR) not only for the Borneo region, but also for Malaysia and the world.

    One of Bicam’s notable features is its commitment to innovation, as reflected in its adoption of a fully virtual filing system. This move is in line with global technology trends, making the arbitration and mediation processes more accessible and efficient. Parties involved in disputes can now submit their documents and evidence online, streamlining the entire ADR process. Wong emphasized that this digital approach positions Bicam as a leading choice for alternative dispute resolution globally.

    Bicam, which was launched in July of this year, aims to provide a conducive environment for the efficient and cost-effective resolution of commercial disputes. Wong expressed his aspirations for Bicam to follow the success stories of renowned institutions such as the Singapore International Arbitration Centre (SIAC) and the Hong Kong International Arbitration Centre (HKIAC), aiming to become a significant contributor to growth across various sectors in Sabah, including tourism, hospitality, and food and beverage industries.

    Wong further praised the Sabah government’s commitment to the success of Bicam by incorporating Bicam’s model clause into contracts involving ministries, departments, and government-linked companies (GLCs). This move signifies the significance of ADR in regional development, providing a solid foundation for Bicam’s operations. Additionally, the involvement of both local and international arbitrators and mediators will contribute to the diversification and expertise of the centre, enhancing its credibility and effectiveness.

    One of Bicam’s aspirations is to establish reciprocal relationships with other ADR centres worldwide, including the Badan Arbitrase Nasional Indonesia (Bani), SIAC, HKIAC, and AIAC. Such collaborations will create opportunities for shared expertise and cooperative efforts that benefit all stakeholders involved. Wong also highlighted that Bicam is aligned with the Sabah Maju Jaya Development Plan (SMJ) in its mission to develop human capital within the region. Through training, education, and professional development programs, Bicam aims to nurture competitive, skilled, and high-quality professionals in ADR, solidifying Sabah as a premier destination for legal services in the region.
