    Dewan Rakyat passes amendments to varsities Act

    The Dewan Rakyat in Kuala Lumpur has approved proposed changes to the Universities and University Colleges Act 1971 (UUCA) that give university students more control over their associations’ activities and finances, thanks to amendments tabled by Higher Education Minister Datuk Seri Dr Zambry Abdul Kadir. The Bill was unanimously passed through a voice vote after being presented for the third reading on Monday (March 18).

    During the debate on the Bill, Zambry delivered the closing speech following discussions by 23 Members of Parliament. He referenced a ministerial-level committee established in 2018 to provide input for a new Act to replace the UUCA, in response to a suggestion by Hassan Abdul Karim (PH-Pasir Gudang).

    Expressing his interest in reviewing the reports from the committee, which comprised ministers and legal experts, Zambry highlighted the continuous efforts to improve the UUCA since its enactment. He noted that the latest amendment, made in 2019, focused on enhancing governance, student activities, and discipline.

    Despite receiving various opinions about potentially replacing the UUCA with a new Act, Zambry emphasized the importance of understanding the underlying goals behind the amendments, particularly regarding student affairs. He mentioned that the 2019 amendment aimed to give students more freedom to engage in political activities both on and off campus, empowering them to seek additional opportunities and responsibilities.

    Utilizing the Madani concept, the ministry believes that students are prepared to take on greater roles by granting them increased freedom to manage association activities and handle student activity finances, based on their readiness and maturity.

    The amendments to the Bill touch upon various sections of the UUCA, with Section 15A now permitting student representative councils and bodies to raise funds and accept contributions, subject to relevant regulations and laws. Section 16B shifts disciplinary authority to the student disciplinary committee from the vice-chancellor, aligning with current practices in public universities.

    Section 48(4) extends the term of office for student council members, considering exceptional circumstances like the Covid-19 pandemic. Section 48(11) allows universities to establish funds managed by student councils according to financial procedures, while Section 49(2) grants student bodies the same facilities as the student representative council.

    Zambry mentioned that the implementation of these amendments would be phased out, with the revised laws expected to bolster student empowerment efforts and enhance the dignity of university students, marking a significant moment as the UUCA undergoes further amendments.
