A 22-year-old diploma student has been accused of committing incest with his sister, who was nearly 13 years old, and has pleaded not guilty to the charges in the Sessions Court in Seremban. The alleged incidents took place in January and March 2021 at their family home in Sikamat.
The accused faces charges under Section 376B(1) of the Penal Code along with Section 16(1) of the Sexual Offences Against Children Act 2017. The Penal Code carries a jail term of 10 to 30 years and whipping upon conviction, while the Sexual Offences Against Children Act carries a jail term of up to five years and whipping.
The Deputy Public Prosecutor, Jiwan Kaur Malkith Singh, requested that bail not be granted, citing the fact that both the accused and the victim lived in the same house. She also informed the court that the victim is currently in the care of the Welfare Department and requested a mention date as they had not yet received the victim’s medical report.
The accused’s lawyer, Haresh Mahadevan, stated that his client had recently completed his diploma in mechanical engineering and was due to start an internship in Johor. He assured the court that the accused had committed not to contact the victim and would stay with his brother-in-law in Seremban upon his return.
Judge Surita set bail at RM10,000 and ordered the accused not to contact the victim, as well as to report to the nearest police station once a month. The mention date was set for March 18.
