BUTTERWORTH: In a recent ruling, the High Court here has upheld the decision of the Sessions Court to acquit and free a former principal of a secondary school who was accused of committing physical sexual assault against four male students in 2018.
Judge Fathiyah Idris carefully evaluated all the facts and expressed satisfaction with the trial judge, who meticulously examined the testimonies of prosecution witnesses.
During the examination of the sixth prosecution witness (SP6), contradictory statements were identified. While there were initial allegations of a series of sexual incidents, SP6 later admitted in cross-examination that these incidents did not occur.
Judge Fathiyah Idris emphasized, “The High Court believes that SP6 was pivotal in determining the matter, but unfortunately could not provide a clear resolution due to contradictions in their testimonies.”
Consequently, the prosecution failed to establish a prima facie case against Zainuren.
Representing the prosecution was Deputy Public Prosecutor Muhammad Shahrezal Mohd Shukri, while the accused was represented by lawyers E. Gnasegaran, Audrey Wee Li Ye, and Vikneshwaran Sehgar.
Zainuren was initially released by the Sessions Court on May 24 last year without being required to enter his defense over the charges.
In January 2019, Zainuren pleaded not guilty to the four counts of physical sexual assault on four male students aged between 11 and 14. These alleged incidents took place at a school in Permatang Tok Jaya between April 16 and October 10, 2018. – Bernama
