KOTA KINABALU: The Kota Kinabalu High Court has granted a 39-year-old man charged with incest a RM10,000 bail after he was previously denied bail by the Sessions Court. Justice Amelati Parnell allowed the bail on Tuesday (July 25) following a successful appeal through a criminal revision.
The accused, a general worker, was charged with committing incest on March 27 with a 12-year-old girl at a house in Manggatal. The offence carries a maximum prison sentence of eight to 30 years and at least 10 strokes of the rotan.
The initial bail application made by the accused’s counsel, Datuk Seri Rakhbir Singh, was denied by Sessions Court judge Amir Shah on May 16. However, following the denial, Rakhbir filed for criminal revision at the High Court.
During the hearing on July 23, Rakhbir informed Justice Parnell that he has not yet received the notes of proceedings from the Sessions Court judge, which prevented the case from proceeding on July 3.
After considering Rakhbir’s submissions, Justice Parnell granted the accused bail with two sureties. In addition to the bail amount, the accused is also required to report to a police station at the end of each month and surrender his international passport.
