A police officer with the rank of inspector has been acquitted and discharged by the Magistrate’s Court in Seremban on a charge of using drugs three years ago.
The decision was made by Magistrate Mohd Firdaus Saleh, who found that the prosecution failed to prove the case beyond reasonable doubt against the accused, 43-year-old Roslan Sam.
In his judgment, Mohd Firdaus stated that the court carefully examined the facts of the case, exhibits, the testimony of the accused and defense witnesses, and re-examined the testimony of the prosecution witnesses.
“Therefore, the court hereby finds that the prosecution had failed to prove the case beyond reasonable doubt. So with this, the accused is released and acquitted of this charge,” he announced.
Roslan, who serves in the Special Branch of the Negri Sembilan headquarters, expressed his relief and gratitude to Mohd Firdaus following the decision.
The charge against Roslan accused him of possessing and using drugs, specifically ketamine, amphetamine (speed), methamphetamine (ice), and methylenedioxy-methamphetamine (ecstasy).
The alleged offense took place at 3am at the narcotics office of the Seremban district police headquarters on September 27, 2020. If convicted under Section 15(1)(a) of the Dangerous Drugs Act, he would have faced a fine not exceeding RM50,000 or a maximum imprisonment of two years.
Deputy Public Prosecutor Nik Nur ‘Aqilah Syarfa Nik Zaidi handled the prosecution, while lawyers Haresh Mahadevan and Ramzani Idris represented the accused.
During the trial in March 2021, seven witnesses testified in court.
Haresh, who was interviewed after the court’s decision, stated that in their submissions, the defense team successfully demonstrated that the police officer was unaware that the drinks served to him and other guests during intelligence work at an entertainment venue were spiked with drugs. – Bernama
