Ratu Naga, a member of Perikatan Nasional, has taken legal action against the government in order to invalidate a provision in the Peaceful Assembly Act (PAA).
She, also known as Syarul Ema Rena, argued in a post on her Facebook page that section 9(5) of the PAA, which mandates organizers to notify authorities in advance of gatherings, was unenforceable.
“I filed a lawsuit on Nov 8 in the Kuala Lumpur High Court seeking a declaration that Section 9(5) of the PAA is unenforceable as it was invalidated in a previous case,” the post read.
“Despite the decision in the earlier case, police have continued to conduct investigations under the now-invalid Section 9(5),” she added.
The statement mentioned that the lawsuit was a result of a police investigation into Syarul Ema’s involvement in the “Save Malaysia” rally on Sept 9, for which she was summoned to the Dang Wangi police headquarters to provide her statement.
Ratu Naga stated that she was being investigated for an offense under section 9(5) of the PAA for not informing the police of the rally, an infraction that carries a fine not exceeding RM10,000 upon conviction.
