Two Rohingya individuals have pleaded not guilty to charges of raping and sexually assaulting a schoolgirl in Ayer Keroh, Melaka. The accused, Mohamad Osman Boshor, 27, and a 14-year-old boy, entered their pleas before separate courts on Thursday (Sept 21). According to the statement of fact filed at the Sessions Court, Mohamad Osman allegedly raped the 15-year-old girl on Sept 14, at approximately 5.30pm, in a car at an open space near Klebang beach. The charge against him falls under Section 376(2) of the Penal Code for rape, which carries a sentence of up to 30 years’ imprisonment and whipping upon conviction. He is also charged with sexual assault under Section 377CA of the Penal Code, which carries the same penalties. The offence is said to have occurred at the same place, time, and location.
DPP Muhammad Nazrin Ali Rahim acted as the prosecutor in the case, while Omar Zulkarnain represented the accused. Bail was set at RM20,000, and the next mention in court is scheduled for Oct 31.
In a separate proceedings at the Magistrate’s Court, the teenage accused faced two charges against the same victim. The charges were framed under Section 14(a) of the Sexual Offences Against Children Act 2017 and Section 376(2) of the Penal Code for physical sexual assault and rape, respectively. The first charge carries a maximum sentence of 20 years’ imprisonment and whipping upon conviction. The teenager is alleged to have committed both offences at the same place, time, and location. The accused was represented by Mohamed Musthafa. Bail was set at RM3,000 for both charges, and the next mention in court is scheduled for Oct 31.
On Sept 20, it was reported that two Rohingya suspects had been arrested in Melaka for the alleged rape of a schoolgirl. The arrests were made following a police report filed by the victim’s brother at the Batang Tiga police station on Sept 15.
