A motorcyclist has been fined RM5,000 by the Magistrate’s Court for mowing down a Road Transport Department (JPJ) enforcement officer at a roadblock.
Security guard Nor Khairul Azwa Azizi, 25, pleaded guilty before Magistrate Uthman Abd Ghani, who also ordered him to serve three months in jail if he could not pay the fine.
Nor Khairul was charged with deliberately crashing into Mohd Nurhakim Mohd Razif at around 11am on Sept 17 at KM28 of the Seremban-Port Dickson Highway.
He was charged under Section 186 of the Penal Code for obstructing a government servant from discharging his duties.
Those convicted can be jailed for up to two years or fined up to RM10,000 or both.
Nor Khairul, who was unrepresented, pleaded for a minimal fine, saying he had to provide for his pregnant wife and a son.
He also told the court he had lost his job due to the incident.
Deputy public prosecutor Nadia Izzaty Mohd Zainal urged the court to impose a deterrent sentence.
“The court also has to take into account the injuries sustained by the officer,” she said.
The JPJ had mounted a roadblock along the stretch when the accused crashed into Mohd Nurhakim.
A five-second video of the incident went viral on social media.
The injured officer had to be taken to hospital for outpatient treatment.
The JPJ had earlier said that Nor Khairul had been blacklisted for offences under the Road Transport Act 1987. This was for not having a valid licence since 2012 and for riding without insurance.
Meanwhile, Bernama reported that the driver of the trailer that ploughed into more than a dozen vehicles at KM5.7 Jalan Persiaran Utara heading towards Puchong here on Wednesday has been remanded for four days.
The remand order against the 29-year-old man was issued by Magistrate Irza Zulaikha Rohanuddin at the Putrajaya Magistrate’s Court after allowing an application by the police.
Two motorcyclists died on the spot after the trailer crashed into vehicles that had stopped to make way for a convoy.
The 10.15am incident involved 14 vehicles, including a police motorcycle outrider.
Putrajaya OCPD Asst Comm A. Asmadi Abdul Aziz said the two victims were identified as Faris Haziq Abu Bakar, 25, a Pos Malaysia employee, and Yuswar Mohd Uyus, 39, who worked in the Ampang Court.
He added that the trailer driver tested negative for drugs and had no record of traffic offences.
The case is being investigated under Section 41(1) of the Road Transport Act 1987.
